Terms of Service

These Terms of Service (the "Terms") govern your access to and use of the websites (including allcoaching.in and studio.allcoaching.in), mobile applications, marketplace, and related services (collectively, the "Services") operated by AllCoaching Technologies Pvt. Ltd., having its registered office at Sangam Vihar Colony, Haveliya, Jhusi, Prayagraj, Uttar Pradesh 211019, India ("AllCoaching", "we", "us", "our"). By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you register as an educator, the Educator Agreement additionally applies to you and prevails over these Terms in case of conflict.

1. Our role — a marketplace, not the coaching provider

AllCoaching operates a technology platform and online marketplace. We are an "intermediary" under the Information Technology Act, 2000 and a "marketplace e-commerce entity" under the Consumer Protection (E-Commerce) Rules, 2020. Courses, classes, test series, and other offerings on the Services are created, priced, and sold by independent educators — the educator is the seller of record, and every purchase forms a contract directly between you and that educator. AllCoaching does not create or verify educator content, does not provide coaching services, and does not guarantee any academic outcome, examination result, rank, selection, or earnings.

2. Eligibility & accounts

You may use the Services only if you can form a binding contract under Applicable Law. If you are a minor, you may use the Services only through, and with the verifiable consent of, your parent or legal guardian, who accepts these Terms on your behalf and is responsible for the account. You are responsible for keeping your credentials secure and for all activity under your account; notify us immediately of any suspected unauthorised use.

3. Educator obligations (summary)

Educators sell on the Services under the Educator Agreement, which requires them, among other things, to: provide accurate information about their identity, offerings, qualifications, and pricing; deliver what they advertise; hold rights to the content they upload; refrain from guaranteed-rank, guaranteed-selection, or other misleading claims; publish a clear refund policy; and comply with Applicable Law, including tax, intellectual-property, consumer-protection, and data-protection law. Each educator's legal identity and contact details are made available on or via their listing as required by the E-Commerce Rules.

4. Student & learner obligations

• Use the Services only for lawful, personal learning purposes.
• Do not record, download (except where a download feature is provided), redistribute, resell, or share paid content — piracy is a breach of these Terms and of law.
• Do not misuse tests, leak questions, or engage in examination malpractice.
• Respect educators and other learners in classes, chat, and reviews; post only genuine, first-hand reviews.
• Provide accurate information at registration and purchase.

5. Purchases, payments & pricing

Prices are set by educators and displayed inclusive of the components stated at checkout. Payments are collected and processed through RBI-authorised payment aggregators; AllCoaching does not store your full card details. The total price, inclusions, access period, and refund terms applicable to a purchase are those displayed at the time of purchase. Platform fees charged to educators and optional Pro-tier pricing are published on our pricing page.

6. Refunds, cancellations & chargebacks

Refund and cancellation terms for each paid offering are set by the selling educator within the platform's baseline refund framework and are displayed before purchase. Refund requests should be raised first with the educator through the Services; unresolved requests may be escalated to our Grievance Officer (Clause 13). Refunds, where due, are processed to the original payment method through the payment aggregator. Nothing in this clause limits your non-waivable rights under the Consumer Protection Act, 2019.

7. Intellectual property

Educators retain ownership of the content they upload and grant AllCoaching a limited licence to host, stream, and display it strictly to deliver the Services. Purchasing a course gives you a personal, non-transferable, non-exclusive licence to access it for your own learning during the stated access period — it does not transfer any ownership or right to redistribute. The AllCoaching brand, platform code, and designs are owned by us and may not be copied, scraped, or redistributed. Copyright complaints may be sent to the Grievance Officer (Clause 13) and are handled under our notice-and-takedown process; repeat infringers' accounts are terminated.

8. Acceptable use

You agree not to: (a) misuse or interfere with the Services; (b) attempt unauthorised access; (c) scrape, data-mine, or reverse-engineer the platform; (d) impersonate any person or misrepresent affiliation; (e) transmit spam, malware, or unlawful content; (f) post fake, incentivised, or misleading reviews; or (g) use the Services in violation of the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 or any other Applicable Law. We may remove content and suspend accounts for violations.

9. Privacy & data protection

We process personal data as a Data Fiduciary under the Digital Personal Data Protection Act, 2023, as described in our Privacy Policy — including what we collect, why, your rights (access, correction, erasure, grievance, nomination), how to withdraw consent, and how we handle children's data. Please read it; it forms part of these Terms.

10. Termination

We may suspend or terminate your account if you breach these Terms, engage in fraud or piracy, harm other users, or where required by law or a lawful order. You may close your account at any time. Provisions that by their nature survive (payments owed, IP, disclaimers, liability limits, governing law) survive termination.

11. Disclaimers

The Services are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, to the maximum extent permitted by law. AllCoaching connects educators and learners; the content, quality, and delivery of every course are the responsibility of the educator who provides it. We do not warrant uninterrupted or error-free operation, and we do not guarantee outcomes, results, ranks, selections, or earnings. Any illustrative figures on the Services are examples, not promises.

12. Limitation of liability

To the maximum extent permitted by law: (a) AllCoaching shall not be liable for any indirect, incidental, special, punitive, or consequential damages, or for loss of profits, data, goodwill, or opportunity; and (b) our total aggregate liability for all claims relating to the Services shall not exceed the fees you paid to AllCoaching (excluding amounts paid to educators) in the three (3) months preceding the first event giving rise to the claim. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Applicable Law, including under the Consumer Protection Act, 2019, or liability for fraud or wilful misconduct.

Grievances are acknowledged within 48 hours and resolved within the timelines prescribed by Applicable Law (generally within one month, and within the shorter periods prescribed for specific categories of content).

14. Changes to the Terms

We may update these Terms from time to time. Material changes will be notified in-product or by email before they take effect. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

15. Governing law & jurisdiction

These Terms are governed by the laws of India. Subject to any non-waivable statutory remedy available to you (including under the Consumer Protection Act, 2019), the courts at Prayagraj, Uttar Pradesh, India shall have exclusive jurisdiction over disputes arising out of these Terms or the Services.
